2025-03-10 Legal Update Letter From the President

Hello Reflection Lake Community,

As most are aware, there was a hearing this last Friday regarding a motion to dismiss the lawsuit. RLCA filed this motion based on completion of everything within our power to complete in the settlement agreement. The motion was denied. The judge ruled that the agreement made is legally binding regardless of fact that some items agreed to are beyond the authority or ability of RLCA.

The two remaining issues are having a third party operator for the water system, with duties, responsibilities, and rights that the operator has taken on, in writing (contract) and signed, which can only be done by the RWA. The second issue is D&O insurance, which we have attempted repeatedly to get only to be denied coverage because of this lawsuit.

We will continue to defend our association as required by law against any legal actions taken against us. Though this lawsuit is stayed, we will continue to pursue completion of the settlement agreement. This agreement is a binding contract and I believe it has been a net benefit to the community. Regardless of the outcome of the lawsuit, this agreement will continue to be in force.

The agreement has resulted in better transparency, stricter adherence to the bylaws, and assessment of the private road users to fund road maintenance (as stated in our covenants). Also this agreement has also brought about recording of the meetings, posting of meeting minutes, a Board Member Code of Conduct for more civility in our meetings, and more open transparency.

We will continue to be as transparent as possible and keep all community members informed. Please help us with this transparency by not muddying the water with gossip or speculation. It is best if communication be done directly and not through hearsay.
